By accessing or using the EngageByte website (the “Site”) or our marketing services (the “Services”), you agree to these Terms of Service. If you do not agree, please do not use the Site or Services.

2. Services

EngageByte provides digital marketing and advertising services, including paid media management, funnel development, lead generation, follow-up systems, and reporting. Specific deliverables are governed by the applicable written service agreement.

3. Eligibility and Site use

You must be at least 18 years old and legally capable of entering into binding agreements. You agree not to misuse the Site, attempt unauthorized access, transmit harmful code, or interfere with normal operation.

4. Fees and payments

Unless otherwise agreed in writing, fees for Services are due according to the applicable agreement. You are responsible for third-party advertising spend paid to platforms such as Meta or Google.

5. Results disclaimer

EngageByte does not guarantee specific advertising, lead, revenue, or appointment results. Marketing performance depends on many factors outside our control, and past performance does not guarantee future outcomes.

6. Intellectual property

Site content, including text, graphics, logos, and software, is owned by EngageByte or used with permission and protected by applicable intellectual property laws. You may not reproduce or distribute it without prior written permission.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy. Do not submit patient information, medical records, or other sensitive personal information through the Site.

8. Third-party platforms and links

The Site and Services may reference or integrate third-party platforms such as Meta, Google, Formspree, or Calendly. Those platforms are governed by their own terms and policies. EngageByte is not responsible for a third party’s availability, security, content, policies, or independent acts.

9. Disclaimer of warranties

To the fullest extent permitted by law, the Site is provided “as is” and “as available.” EngageByte disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will always be uninterrupted, error-free, or completely secure. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, EngageByte shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or Services. Any additional limitations applicable to paid Services are stated in the relevant service agreement.

To the extent permitted by law, you agree to indemnify and hold EngageByte harmless from third-party claims, damages, and reasonable costs arising from your unlawful misuse of the Site, your violation of these Terms, or content and information you provide through the Site or Services.

12. Suspension and termination

We may restrict or terminate access to the Site when reasonably necessary to prevent misuse, protect security, comply with law, or enforce these Terms. Provisions that by their nature should survive termination will remain effective.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law principles. Subject to applicable law, disputes concerning the Site or these Terms will be brought in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.

14. General provisions

If a provision of these Terms is found unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. These Terms and any applicable written service agreement constitute the entire agreement concerning their respective subject matter. If these Terms conflict with a signed service agreement, the signed service agreement controls for the Services it covers.
